Amendments to Licensing and Equipment Regulations

On May 4, 2023, the Minister of Digital Government and Service in Newfoundland and Labrador, promulgated Regulation 37/23, which amends the Licensing and Equipment Regulations under the Highway Traffic Act. These amendments introduce updates aimed at enhancing the clarity and effectiveness of vehicle and equipment regulations.

The primary changes include the repeal of Sections 3 and 4, which previously addressed general licensing and identification plates. This repeal marks a restructuring of the regulatory framework, in an attempt to streamline the licensing process and the management of identification plates. Additionally, Section 5 has been revised to stipulate that vehicles registered to government entities or municipalities must have their registration and identification plates returned to the registrar before being sold to private parties. This ensures that the registration process is concluded before ownership transfers.

Further amendments to Sections 21 and 28 involve the replacement of generic terms with specific references to “the minister’s” requirements. These changes aim to provide clearer regulatory authority and oversight, particularly concerning vehicle lighting and the use of studded tires. Sections 42.1 and 42.2 have also been comprehensively amended to clarify language related to the inspection of commercial vehicles and carrier operations.

Subsection 44.1 and Section 46 have been updated to ensure that bicycle helmets and motor vehicles conform to the latest Canadian safety standards, as outlined in the Motor Vehicle Safety Act. Similarly, Section 48 now mandates that equipment for mobile homes and recreational vehicles meet the Canadian Standards Association’s requirements, aligning with current standards for these types of vehicles.

Section 50.2 has been revised to clarify the role and duties of inspectors, replacing individual responsibility terms with references to “the inspector.” This adjustment aims to provide clearer enforcement practices and regulatory oversight.

Regulation 37/23 attempts to modernize and clarify the vehicle and equipment regulatory framework in Newfoundland and Labrador. By refining terminology and updating compliance requirements, these amendments enhance regulatory precision, attempt to align with contemporary safety standards, and streamline the processes for vehicle and equipment sales and inspections.
