Changes in B.C.’s Adoption Financial Assistance
On June 26, 2023, the Government of British Columbia introduced B.C. Reg. 160/2023, amending existing regulations under the Adoption Act. These changes primarily focus on financial assistance for applicants involved in the adoption process.
One of the key changes in the Adoption Regulation is the repeal of Section 29, which previously addressed assistance agreements related to adoption. The new section not only defines critical terms but also outlines the procedures for financial assistance. A significant addition is the introduction of the term “eligibility period.” This period begins when a director determines an applicant’s eligibility and ends when the applicant enters into a written agreement with the director. This new regulation emphasizes that financial assistance will not be provided until a signed written agreement is in place, detailing the types of financial support available during the eligibility period, any assistance available after the agreement is signed, and the conditions governing the distribution of this assistance.
Additionally, the previous Schedule 4, which contained the Net Income Threshold and Payment Table, has been replaced. This schedule was crucial for determining income limits and the financial support available to applicants.
By establishing the eligibility period and requiring formal agreements, the regulation aims to create a transparent process for applicants. This clarity allows applicants to better understand the support they can expect, enhancing their ability to plan for the adoption process. Furthermore, the requirement for a written agreement fosters accountability by ensuring both the applicant and the director have a formal record of the assistance to be provided and its conditions.
