On August 2, 2023, the Nova Scotia Minister of Environment and Climate Change issued N.S. Reg. 142/2023, the Packaging, Paper Products and Packaging-Like Products Material Management Standard. This regulation is enacted under clause 8A(1)(c) of the Environment Act, forming part of the broader legislative framework governing environmental management in the province. The regulation serves as a part of Nova Scotia’s Extended Producer Responsibility (EPR) program, aimed at improving the management of packaging materials and related products. The EPR initiative mandates that producers assume responsibility for the entire lifecycle of their products, particularly in terms of waste management and recycling, ensuring that packaging materials are handled sustainably.

The regulations specify that the adopted standard outlines the minimum material management requirements for designated materials, including packaging, paper products, and packaging-like products. These requirements are vital for ensuring compliance among manufacturers and businesses producing or utilizing these materials in Nova Scotia. The document also indicates that the standard may be amended or replaced over time, reflecting a commitment to adapt to new environmental challenges and advancements in material management technology.

To promote transparency and public engagement, the regulations require that the adopted standard be readily available to the public. This includes publishing the standard on the Department of Environment and Climate Change’s official website for easy access by stakeholders such as businesses, consumers, and environmental advocates. Additionally, the standard must be accessible at the Department’s office located at 1903 Barrington Street, Suite 2085, Halifax, Nova Scotia. This dual approach aims to foster greater awareness and understanding of the regulations among the public and relevant stakeholders.

The adoption of this standard is to aid more sustainable waste management and recycling practices in Nova Scotia. By establishing clear guidelines for producers, the regulation aims to minimize the environmental impact of packaging materials, contributing to broader climate change mitigation efforts. Businesses involved in producing or using packaging and related materials will need to review and adjust their practices to comply with the new minimum requirements, which may involve changes in design, materials, and the implementation of more effective recycling processes.

By adopting N.S. Reg. 142/2023, the province intends to promote sustainable waste management practices while enhancing producers’ accountability for their products’ lifecycle.
