New Eligibility and Insurance Rules for Employment Programs
Saskatchewan Regulations 20/2023, entitled “The Employment Program Amendment Regulations, 2023,” amend the Employment Program Regulations, 2021. The amendments include:
Modification of Section 3 of the Employment Program Regulations, 2021 and establishes the following criteria for eligibility to receive financial assistance under Part 3 of the Employment Program:

- Citizenship Status: Applicants must be Canadian Citizens or permanent residents as defined by the Immigration and Refugee Protection Act (Canada).
- Temporary Residents: Individuals holding a temporary resident permit may be eligible if approved by the minister.
- Additional Criteria: Applicants must also meet any other eligibility criteria specified by an applicable program established under Section 4.01 of The Human Resources, Labour and Employment Act.

Revisions to Section 9 address liability insurance requirements:

- General Requirement: Applicants who receive financial assistance must ensure that participants in approved projects are covered by adequate liability insurance to protect against potential damage or injury resulting from project participation.
- Exemptions: This requirement does not apply to individual applicants who are not employers. In other words, if the applicant is a private individual rather than an employer, they are exempt from the obligation to provide liability insurance for participants.

The primary aim of these amendments is to refine eligibility criteria for financial assistance, ensuring that only qualified individuals benefit from employment programs. Additionally, the adjustments to liability insurance requirements are intended to balance the need for protection with practical considerations for individual applicants. This may reduce the administrative burden on private individuals while still safeguarding participants in funded projects.
