New Guidelines for Alcohol Sale and Distribution

In April 2023, Saskatchewan enacted new regulations under The Alcohol and Gaming Regulation Act, 1997, designed to update and clarify the rules governing the sale and distribution of alcohol. These revisions, formally known as The Alcohol Control Amendment Regulations, 2023.

The regulations introduce several significant changes. Firstly, they include new definitions for different types of markets. A “farmers’ market” is now defined as a market that is approved by the municipality, operates on a regular basis for at least three consecutive months, primarily sells agricultural and food products, and is managed by a board of directors or an advisory committee. In addition, a “public market” is characterized as a year-round market operating at a fixed location, offering a diverse range of goods from multiple vendors, and requiring both municipal and health authority approval.

The regulations expand the scope of venues where alcohol regulations apply. Specifically, hotel and motel lobbies, along with premises within public markets, are now included in the list of regulated locations. This means that the sale of alcohol in these settings is subject to the same regulatory standards as other designated areas.

Moreover, Section 49 of the regulations has been updated to specify the permitted hours for alcohol sales. Retail stores may now operate from 8:00 a.m. to 3:00 a.m. the following day, with extended hours on New Year’s Eve. Other establishments, such as bars and restaurants, can sell alcohol from 9:30 a.m. to 2:00 a.m. the next day, with similar extensions on New Year’s Eve. Local municipalities or Indian bands have the authority to impose more restrictive hours if desired.

Additional amendments address operational rules for permit holders. Notably, subsection 25(3) has been repealed, and updates to sections 28, 31, 48, and 51 refine the application of operational hours and permit conditions. Furthermore, Section 69 now requires that all spirits served in drinks be measured using devices that clearly indicate the amount being served.

These regulations took effect immediately upon their filing with the Registrar of Regulations on April 26, 2023. Overall, the amendments aim to provide clearer guidelines and enhance the regulation of alcohol sales, ensuring more consistent enforcement across various venues and market types.
