New Brunswick Regulation 2023-64, known as the Skills and Qualifications Regulation – Local Governance Commission Act, was filed on November 20, 2023. This regulation establishes the specific skills and qualifications required for members of both the Local Governance Commission and the Tribunal, in accordance with the mandates outlined in the Local Governance Commission Act (2023, c. 18).

It outlines the qualifications necessary for members of the Local Governance Commission, particularly focusing on the Chair and appointed members. The Chair must possess experience in local governance or a combination of local governance and public administration and must be bilingual, capable of speaking and understanding both of Canada’s official languages. All appointed members are required to have training and experience in at least one of the following areas: local, regional, or board governance; municipal law; or municipal financial management or administration. Furthermore, the Commission must include at least one member who is a barrister and solicitor with a minimum of five years in good standing with the Law Society of New Brunswick, as well as at least one member who is in good standing with the Chartered Professional Accountants of New Brunswick, thereby ensuring financial oversight and accountability.

The regulation similarly specifies qualifications for the Tribunal. The Chair and at least one Vice-Chair of the Tribunal must also be bilingual, capable of effectively communicating in both official languages. The Tribunal must include at least two members, including alternates, with training and experience in real estate appraisal or property assessment, with provisions to avoid any conflicts of interest. Additionally, at least two members must have training and experience in land use planning, adhering to the same conflict-of-interest guidelines.

This regulation aims to ensure that both the Local Governance Commission and the Tribunal operate with qualified and competent members. By establishing clear requirements for experience and training, the intention of the regulation is to improve the quality of governance within local jurisdictions in New Brunswick.
