Professional Misconduct Within the Field of Denturism

Ontario Regulation 227/24 was made under the Denturism Act, 1991. This regulation amends Ontario Regulation 854/93 concerning professional misconduct within the field of denturism, refining and redefining various aspects of professional conduct for denturists in Ontario. The amendments primarily focus on clarifying definitions of professional misconduct, improving patient protection, and ensuring compliance with ethical and professional standards.

One significant change involves the revocation of existing paragraphs 1 to 8 of section 1, which are replaced with new definitions that provide a clearer understanding of professional misconduct. Members are now explicitly prohibited from contravening any terms or conditions of their registration or standard of practice. Additionally, they are held accountable for ensuring their capability when performing controlled acts to safeguard patient well-being. Stronger measures are also introduced against any form of abuse—verbal, physical, psychological, or emotional—directed towards patients or their representatives.

The regulation places a strong emphasis on proper delegation practices, requiring denturists to ensure that any controlled acts delegated to others are conducted under appropriate supervision, and that the delegatee possesses the necessary skills and knowledge. Denturists must fulfill all terms of agreements with patients regarding services or products and cannot discontinue professional services without considering the patient’s condition and the availability of alternative care.

Furthermore, the regulation explicitly prohibits denturists from acting in a professional capacity while in a conflict of interest, prioritizing patient interests. Stricter rules regarding advertising practices are also imposed, preventing misleading claims and ensuring that testimonials are factual and verifiable.

Stricter regulations on record-keeping require denturists to maintain accurate and comprehensive patient records in line with professional standards. They are now required to provide itemized accounts for services in an understandable format and communicate any fees or penalties associated with late payments before providing services. Additionally, the regulation prohibits excessive or unreasonable fees in relation to the services provided, enforcing transparent billing practices that allow patients to comprehend their charges clearly.

Denturists must comply with all federal, provincial, and municipal laws that promote public health and safety. Any contravention that questions their suitability to practice is also classified as professional misconduct. The amendments include stricter reporting obligations for unsafe practices and compliance with the orders of the College.

By clarifying definitions and adding new provisions, the regulation aims to improve patient protection, ensure compliance with ethical standards, and strengthen the integrity of the denturism profession in Ontario.
