Declarations of Integrity
The “Gouvernement du Québec O.C. 1077-2024” pertains to the Act respecting contracting by public bodies (chapter C-65.1) and introduces a regulation that specifies the form of a declaration of integrity that enterprises must file when bidding for public contracts. This regulation establishes a legal framework to ensure that enterprises adhere to integrity standards when engaging in public contracts. It mandates that all enterprises responding to a call for tenders submit a written declaration affirming their awareness and commitment to upholding these integrity standards for the entire duration of the contract.
According to section 21.2 of the Act, any enterprise submitting a bid for a public contract must file this declaration. The purpose of the declaration is to confirm that the enterprise recognizes the importance of integrity standards in public contracts and commits to abiding by these principles, which include transparency, honesty, and ethical conduct. The regulation aims to prevent misconduct and ensure ethical behavior in public contracts.
The content of the declaration is clearly outlined. Enterprises are required to declare their understanding of the integrity standards expected by the public. These standards are specified in sections 21.26, 21.26.1, and 21.28 of the Act. By signing the declaration, enterprises acknowledge their commitment to complying with these standards, which cover essential elements such as honest dealings, fair competition, and the prevention of corrupt practices in the execution of public contracts.
This regulation underscores the importance of maintaining high standards of integrity for enterprises involved in public contracting. It reflects the government’s commitment to ensuring ethical conduct and transparency in the use of public funds. By requiring enterprises to explicitly acknowledge these integrity standards, the regulation aims to deter unethical behavior, such as fraud, corruption, and unfair competition, which can erode public trust in government contracting processes.
The integrity standards referenced in the declaration cover a range of public contracting behaviors, including truthful reporting, proper financial management, compliance with relevant laws, and the avoidance of conflicts of interest. The declaration serves as a formal commitment from enterprises to uphold these principles, thereby promoting fair competition and accountability throughout the contract’s duration.
The introduction of this regulation is a key step in reinforcing the legal framework governing public contracts in Québec. By mandating a formal declaration of integrity, the government aims to protect the public interest and ensure that enterprises engaged in public projects adhere to ethical practices. This effort aligns with broader global trends in public procurement reform, where governments are increasingly focusing on promoting integrity, reducing corruption, and improving the efficiency of public spending.
