Regulating Residential Cannabis Sales and Cultivation

Manitoba Regulation 33/2025 amends the Cannabis Regulation, Manitoba Regulation 120/2018 by introducing several changes related to cannabis cultivation and distribution. This regulation seeks to update the rules governing cannabis production, particularly residential cultivation, and the responsibilities of licensees in the province. One of the most significant changes is the introduction of the term “illicit cannabis,” defined according to the Cannabis Act (Canada), which clarifies what constitutes unauthorized cannabis under provincial law.

The regulation also makes provisions regarding the cultivation of cannabis in private residences. Subsection 2.2(3) permits individuals cultivating cannabis at home, in accordance with Part 5 of the regulation, to possess cannabis that has not been packaged, labeled, or stamped according to the requirements outlined in subsection 101.15.2(2) of the Act, provided the cannabis remains within their residence.

Other amendments include the repeal of Section 7 and Section 21, as well as the renumbering of Section 14 to subsection 14(1), with an added provision in subsection 14(2) that limits the sale of cannabis plants to no more than four per person in a single transaction. This change further regulates the sale of cannabis by licensees and ensures that no individual can acquire an excessive number of plants in one purchase, promoting better control over the distribution of cannabis.

The regulation also amends the heading for Part 4 to include “RE LICENSEES,” indicating a more specific focus on the responsibilities and regulations for cannabis licensees in Manitoba. A new section, Part 5, is introduced, dealing specifically with residential cannabis cultivation. Section 49 of Part 5 outlines who may engage in cannabis cultivation at home, specifying that individuals 19 years or older are allowed to cultivate up to four cannabis plants in their ordinary residence. However, it is prohibited for individuals to cultivate plants at multiple residences at the same time, and in households with two or more individuals over the age of 19, the total number of plants cultivated in the residence cannot exceed four.

Additionally, Section 50 outlines the requirements for individuals cultivating cannabis in their residences. Cultivators must use seeds or plant materials that are not illicit cannabis, ensuring that only legally sourced cannabis is grown. Moreover, all cultivation must take place indoors, in a secure room or container, and in a location that is not accessible to minors.

Manitoba Regulation 33/2025 brings several updates to the province’s cannabis regulations, with a focus on residential cultivation, the sale of cannabis plants, and clarifications regarding illicit cannabis. These changes aim to provide clear guidelines for both individual cultivators and cannabis licensees, ensuring that cultivation practices are responsible and regulated, while also maintaining a safe environment for all residents.
