Capturing Speeders, Protecting Kids
The Newfoundland and Labrador Regulation 103/25 represents an amendment to the Image Capturing Enforcement System Regulations under the Highway Traffic Act. The regulation, enacted under the authority of section 186 of the Highway Traffic Act, introduces updates to the operation, evidence handling, and testing of image capturing enforcement systems, particularly to improve road safety measures and support law enforcement in monitoring traffic violations. The amendments reflect both technical clarifications and expansions of the types of systems recognized under the Act, with a particular focus on school bus stop arm mounted photo and video systems.
The first amendment pertains to the definitions within the regulations. Paragraph 2(b) of the original regulations, NLR 61/21, is revised to include a new subparagraph recognizing school bus stop arm mounted photo and video systems as part of the array of image capturing enforcement tools. This addition reflects a targeted effort to improve the safety of school children by ensuring compliance with laws prohibiting passing stopped school buses.
The second amendment addresses the evidentiary requirements associated with images captured by enforcement systems. Subsection 3(1) is repealed and replaced with a more detailed framework specifying the information that must accompany reproductions of images obtained through these systems. For standard image capturing enforcement systems, including those already recognized under subparagraphs 2(b)(i) to (v), the required data now explicitly includes the date and time of capture, the location of the enforcement system, the vehicle’s recorded speed in kilometres per hour, the posted speed limit at the location, and the direction of travel. These requirements ensure that any captured image can serve as admissible and reliable evidence in legal proceedings. For the newly recognized school bus stop arm systems, the regulations require that the reproduction of the image include the date, time, and location, thereby providing sufficient context to verify incidents of illegal passing while prioritizing the protection of children without imposing overly burdensome data requirements.
The third amendment relates to the testing and operational standards of enforcement systems. Paragraph 4(2)(b) is modified to include the school bus stop arm mounted systems alongside other enforcement technologies. The amendments ensure that these systems are subject to the same rigorous testing protocols, reinforcing the reliability and accuracy of captured data.
The inclusion of school bus stop arm mounted photo and video systems attempts to be a proactive approach to public safety, emphasizing the protection of vulnerable road users while maintaining precise evidentiary standards. The amendments provide clarity on definitions, the handling of evidence, and testing procedures, ensuring that all enforcement technologies operate consistently, transparently, and effectively in support of traffic law enforcement objectives. This regulatory update aims to target safety-driven improvements to the province’s traffic enforcement landscape.
