Lotteries Regulations Level Up
The Lotteries Regulations were amended under the Lotteries Act through R-046-2025 with the changes authorized by the Commissioner in the Executive Council under section 4 of the Act. These amendments focus on refining definitions, updating licensing procedures, introducing fees, and accommodating a new type of raffle known as the Chase the Ace raffle. Subsection 1(1) was revised to add the definitions of “Chase the Ace raffle” and “raffle.” A Chase the Ace raffle is a progressive, multiple-draw raffle in which winners of individual draws receive an event prize based on a percentage of gross ticket sales and an opportunity to pull a card from a deck. If the target card is drawn, the winner claims the progressive jackpot, calculated as a percentage of the total raffle proceeds; if not, the card is removed for subsequent draws. The general term “raffle” now includes single-draw raffles, multiple-draw raffles other than progressive raffles, and Chase the Ace raffles.
Several French language corrections were made for consistency, including replacing “proposée” with “projetée” in subsection 5(2) and “licence de tirage” with “licence de tombola” in subsection 66(2). The amendments require that lottery licence applications must include applicable fees as set out in the newly established Schedule 2. Subsection 9(3) and paragraph 9(4)(a) were revised to reference Schedule 1, and Section 11 was renumbered with a new subsection 11(2) stipulating that licence amendment requests must also include a fee from Schedule 2. Subsection 66(4) introduces an expiration condition for Chase the Ace licences, which terminate on either the date the target card is drawn or the licence expiry date, whichever occurs first.
Detailed changes to the information required for licence applications and reporting were introduced. Section 64 now specifies, for Chase the Ace raffles, the need to report the event prize percentage, progressive jackpot percentage, the initial number of cards in the deck, and the identity of the target card. For other raffles, applicants must report the number and value of prizes, including any merchandise or donated prizes. Section 69 mirrors these updates, including the maximum number of tickets printed and details related to each draw. Section 73’s French version was updated to allow participants assisting with a raffle to purchase tickets from other members of the sponsoring charitable or religious organization. Section 74 aligns reporting requirements with the new definitions and distinctions between Chase the Ace and other raffles, ensuring clarity on prize values, deck composition, and ticket printing.
The amendments also rename the original Schedule as Schedule 1 and introduce Schedule 2, which establishes application and amendment fees for lotteries. Specifically, a lottery licence application submitted at least one month in advance requires a $75 fee, applications submitted less than one month prior incur a $175 fee, and requests to amend a lottery licence carry a $50 fee. Additionally, the Lottery Licences Fees Regulations of 1990 are repealed. These amendments collectively modernize the Lotteries Regulations, introduce clear guidelines for the new Chase the Ace format, standardize fee structures, and ensure consistent language use in both English and French. The regulations come into force fourteen days after registration with the Chief Legislative Counsel.
