Code of Ethics for Sexologists
The draft Regulation amending the Code of ethics of sexologists, under the Professional Code (chapter C-26), has been published for consultation and reflects recent legislative changes in Quebec. The primary objective of the draft Regulation is to update the Code of ethics of sexologists (chapter C-26, r. 222.1.2.01) to align with the Act to amend the Professional Code to update the profession and to broaden certain professional practices in health and social services (2024, chapter 31). This legislative update allows members of professional orders to carry out their professional activities within organizations created primarily for that purpose, regardless of their juridical form, provided certain conditions are met.
In practical terms, the amendment replaces references to “partnership or joint-stock company” throughout the Code with the broader term “organization” and adjusts language related to employment relationships to reflect this organizational flexibility. Section 1 of the Code is amended to substitute “organization” for “partnership or joint-stock company” in its second paragraph. Sections 3, 32, 37, 43, 54, 68, and 80 similarly undergo adjustments to replace references to partnerships or corporations with the term “organization.” Section 26 is revised to replace references to “an employer” and “their employer” with “an organization” and “that organization,” reflecting the broader structural possibilities for professional practice.
The draft Regulation is not expected to have any impact on enterprises, including small and medium-sized businesses, as the amendments pertain specifically to the professional context of sexologists and their ethical framework rather than commercial operations.
The Regulation formalizes the transition to the update terminology and the broader options for professional practice. Overall, the draft Regulation is intended to update the ethical framework governing sexologists in Quebec, facilitating more flexible organizational arrangements while maintaining adherence to professional standards and regulatory oversight.
