Changes to Broadband Project Reporting
Ontario Regulation 282/26 amends Ontario Regulation 410/22, Electricity Infrastructure – Designated Broadband Projects, under the Ontario Energy Board Act, 1998. The amendment changes deadlines and reporting requirements for designated broadband projects. Although the changes are relatively narrow, they affect the timing and frequency with which information relating to these projects must be submitted.
The regulation primarily changes references to November to September in two provisions of O. Reg. 410/22. Under subsection 5 (2), paragraph 1, the regulation replaces “November” with “September” in the provision preceding subparagraph i. This change moves the applicable deadline or timing requirement two months earlier. The same adjustment is made to paragraph 2 of subsection 11 (2), replacing “November” with “September.” These amendments establish September rather than November as the relevant month for the requirements covered by those provisions.
O. Reg. 282/26 also changes the reporting schedule under subsection 11 (2), paragraph 4. Previously, the provision required a particular reporting requirement to be addressed “In the first report and every subsequent third report.” The amendment replaces this wording with “In the reports required to be submitted in January, April, July and October in each year.” This creates a more explicit quarterly reporting schedule. Rather than identifying reports by their sequence, the regulation identifies the specific months in which the relevant reports must be submitted.
The change provides greater clarity about when the required information is expected. Reports covered by the amended provision are now expressly tied to January, April, July and October. This represents four reporting periods each year and establishes a predictable schedule for the information required under the regulation. The change may also make compliance easier to administer because regulated parties can determine the applicable reporting periods directly from the calendar rather than calculating which report qualifies as the first report or every subsequent third report.
The change fits within Ontario’s much larger broadband expansion program. The provincial government says that more than 96% of Ontarians currently have access to high-speed internet and has committed nearly $4 billion to broadband expansion, with the stated objective of reaching all homes and businesses by the end of 2028. Ontario’s Building Broadband Faster guideline was updated recently on August 14, 2026, the same day O. Reg. 282/26 was filed.
