From Two to One: Nursing and Midwifery Unite

The EC2026-146 regulations under the Regulated Health Professions Act formalize the amalgamation of the College of Licensed Practical Nurses of Prince Edward Island and the College of Registered Nurses and Midwives of Prince Edward Island into a single corporate body known as the Prince Edward Island College of Nursing and Midwifery. This new body, established under sections 2 and 96 of the Regulated Health Professions Act, assumes responsibility for regulating multiple health professions, including midwifery, nursing, practical nursing, and psychiatric nursing. The regulations outline the structural, legal, and transitional measures necessary to ensure a seamless integration of the two previously separate colleges, clarifying property rights, obligations, council continuity, appointments, membership, and permits.

The regulations establish that upon amalgamation, the property of each former college automatically transfers to the new amalgamated college, which also assumes all legal and financial obligations of the predecessor institutions. This includes responsibility for existing causes of action, claims, or liabilities, ensuring that ongoing legal, civil, criminal, or administrative proceedings involving either of the previous colleges can continue under the new college without disruption. Similarly, any convictions, rulings, or judgments that were enforceable against or in favor of either predecessor college remain enforceable against or by the amalgamated college, preserving the legal and operational continuity necessary for regulatory governance and accountability.

Council continuity is also addressed in the transitional provisions, stipulating that the members of the councils of the two former colleges immediately prior to the coming into force of the regulations will serve as the initial council of the new college. These members retain their terms of office unless they resign or otherwise cease to hold office before the expiry of their terms. Additionally, any individuals appointed by the councils of the former colleges to roles such as investigators, members of investigation committees, or members of discipline committees are recognized as holding equivalent appointments under the new college. This ensures that ongoing oversight, investigative, and disciplinary functions are uninterrupted during and after the transition.

Membership continuity is similarly guaranteed, with all persons who were members of either of the former colleges immediately before the regulations take effect continuing as members of the amalgamated college. Permits previously issued by either college are also deemed to have been issued by the new college, maintaining professional licensure and practice rights without the need for reissuance or administrative delay. These provisions collectively ensure that all operational, regulatory, and legal processes continue seamlessly despite the structural consolidation of the two colleges.
