The Early Learning and Child Care Standards Regulations are established under Section 47 of the Child Day Care Act, with guidance from the Minister and enforcement by the Commissioner. These regulations are intended to ensure that early childhood care and education remain consistent and of high quality across various settings.

The regulations provide definitions for essential terms and categorize facilities. A centre-based facility is an early learning and child care setting that is not located in a private home. In contrast, a home-based facility operates within the private residence of the provider. Key roles are defined, including the Chief Public Health Officer and public health officers, who ensure the facility meets health standards. Staff roles such as primary staff person, support staff person, and volunteer are also clearly defined to outline their responsibilities.

To obtain a license, operators must submit a detailed application to the Director of Child Day Care Services, which does not involve any fees. The application should specify whether the facility is centre-based or home-based and describe the early learning and child care programs it will offer. Required documentation includes a statement of the program’s goals, floor plans, fire and health compliance reports, proof of insurance, and for home-based facilities, criminal record checks for all adults in the household.

Licenses are granted for both centre-based and home-based facilities. For home-based facilities, the maximum number of children allowed is eight. Licenses are issued for up to one year and may include specific conditions. These licenses can be renewed, provided the facility adheres to the Act and regulations, although the Director may alter the terms upon renewal.

The regulations specify three types of early learning and child care programs:

      • Full-time: More than five consecutive hours per day.
      • Part-time: Five consecutive hours or less per day.
      • Out-of-school: Care provided outside regular school hours.

For newly licensed facilities, the maximum monthly fees are $1,030 for infants, $1,020 for preschoolers, and $340 for school-aged children.

The Director maintains a registry with crucial details about each facility, including the names of the operators or board members and the contact information for the primary staff person.

These regulations are designed to standardize and maintain high standards in early learning and child care. They ensure that all children receive safe, effective, and developmentally appropriate care, demonstrating a commitment to quality and accountability in early childhood education.
