Ontario Regulation 189/23, issued under the Planning Act on July 7, 2023. This regulation allows for the establishment of a 12-bed detoxification centre in a building with frontage on Paddock Wood, thus expanding the uses permitted under the existing City of Peterborough Zoning By-law No. 1972-120. The regulation defines “zoning by-law” as the current zoning framework for Peterborough and applies to specific lands identifiable by map number 337, which is archived at the Ministry of Municipal Affairs and Housing in Toronto. This localized approach facilitates land-use adjustments without altering the broader zoning by-law.
A key aspect of this regulation is the introduction of a detoxification centre as an additional permitted use, which will provide addiction treatment and residential withdrawal management services. Additionally, the regulation establishes several terms of use for the property. All land uses and structures must comply with the terms outlined in this Order, and pre-existing lawful uses of land or buildings are protected from the Order’s restrictions if established before its effective date. Reconstruction of any buildings damaged beyond the owner’s control is allowed, provided that the dimensions and original uses remain unchanged, and restoration efforts to ensure safety in buildings are permitted, promoting community safety and integrity. This regulation is deemed to function as a by-law passed by the City of Peterborough’s council, granting it the legal status necessary for compliance enforcement.
