Crackdown Tightens for Ticket Sales Conduct

O. Reg. 173/26 amends Ontario Regulation 17/05 under the Consumer Protection Act, 2002 to expand transparency and reporting requirements related to enforcement actions under the Ticket Sales Act, 2017. The regulation introduces detailed disclosure obligations concerning administrative orders, voluntary compliance undertakings, court orders, administrative penalties, and complaints involving ticket businesses, and integrates these requirements into existing consumer protection reporting frameworks.

O. Reg. 173/26 adds section 87.1 to O. Reg. 17/05, prescribing information that must be collected and publicly reported for enforcement actions under sections 20 to 23, 25, 26, and 30 of the Ticket Sales Act, 2017. For each relevant order, the prescribed information includes the date, description, summary of the Director’s grounds, and the final outcome of any subsequent proceedings. For undertakings of voluntary compliance, the required disclosure includes the date and terms of the undertaking. For Superior Court of Justice orders, additional detail is required regarding the Director’s application grounds and procedural outcomes. Administrative penalty orders must similarly include their date, description, rationale, and outcomes. The regulation also mandates disclosure of identifying business information for affected persons, including names, contact coordinates, and any business aliases known to the Ministry.

O. Reg. 173/26 further amends section 88 to extend reporting of charges to include those laid under the Ticket Sales Act, 2017 on or after April 24, 2026, alongside existing reference to charges and convictions. Section 90 is also expanded to ensure that complaints involving ticket transactions are explicitly captured when they concern conduct that may contravene the Ticket Sales Act, 2017. New subsections require additional reporting where complaints meet specified criteria, including disclosure of whether orders, undertakings, or charges have resulted, and the associated enforcement details. These provisions ensure that consumer complaints involving ticket businesses trigger improved transparency obligations and structured reporting of enforcement outcomes.

O. Reg. 173/26 also updates inspector enforcement provisions under section 91 to include the Ticket Sales Act, 2017 alongside existing statutes, ensuring that notices of apparent non-compliance may be issued for ticket-related conduct on or after April 24, 2026. These amendments align investigative and enforcement mechanisms across consumer protection regimes, extending consistency in regulatory oversight..
