Specialist Title for Condo Market Professionals
The draft Regulation under the Real Estate Brokerage Act establishes a voluntary professional designation for licensed real estate brokers in Québec: the title of “residential condominium specialist.” Its primary purpose is to define the conditions under which a broker may obtain and use this title, as well as the circumstances in which it may be withdrawn. The framework is intended to formalize a higher level of competency in condominium transactions without making the designation mandatory for brokers involved in the sale or purchase of residential condominiums.
To qualify for the title, a real estate broker must hold a valid licence that is not suspended and is not subject to restrictive conditions, except in limited cases specified under related licensing regulations. The applicant must also have completed specific training within the 12 months prior to application. This training must be provided by the Organisme d’autoréglementation du courtage immobilier du Québec or an approved trainer and must cover competencies outlined in a designated framework made available by the organization. In addition to training, the broker must demonstrate practical experience by having acted as an intermediary in at least five completed real estate brokerage transactions involving the sale or purchase of residential condominium units within the previous three years.
The application process requires submission to the regulatory organization, along with supporting documentation, including proof of training completion and detailed evidence of qualifying transactions such as property addresses, contract numbers, and transaction dates. An administrative fee of $125 is required to have the application reviewed. The regulation also provides that the application will only be considered complete once all required information, documents, and fees have been received.
Once granted, the designation is not permanent without ongoing compliance. Holders must complete and pass annual continuing education or additional training as prescribed by the regulatory body, beginning the year after obtaining the title and continuing each year thereafter. This ensures that specialists maintain current knowledge relevant to condominium brokerage practices.
The title may be withdrawn under several conditions. A holder may voluntarily request withdrawal, or the regulatory organization may revoke it if the broker no longer meets eligibility criteria or if the designation was obtained or used through false or misleading representations. Individuals whose title has been withdrawn may request a review, but the withdrawal will stand unless they demonstrate that the issue has been corrected.
The regulation also introduces restrictions on the use of protected titles. Individuals who have not obtained the designation are prohibited from using terms such as “residential condominium real estate specialist” or similar variations that could imply specialized expertise. Unauthorized use constitutes an offence and may result in a monetary administrative penalty of $250.
